Agreement to Terms

Welcome to Property Aura! These Terms of Service ("Terms") constitute a legally binding agreement between you and Property Aura regarding your use of our property management platform and related services.

Property Aura is designed specifically for small landlords and property owners who need efficient, user-friendly tools to manage their rental properties, tenants, finances, and maintenance activities.

Important: By accessing or using Property Aura, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our services. Please read these Terms carefully before using Property Aura.

Service Description

Property Management Platform

Property Aura is a comprehensive property management software platform designed specifically for small landlords managing 1-50 rental properties. Our services include property tracking, tenant management, rent collection, expense tracking, financial reporting, maintenance coordination, and AI-powered landlord assistance.

Target Users

Our platform is designed for individual property owners, small landlords, real estate investors, and property management professionals who need efficient tools to manage their rental properties and tenant relationships.

Geographic Availability

Property Aura is available to users in the United Kingdom, United States, European Union, Canada, and other selected regions. Some features may vary by location due to local regulations and requirements.

Service Modifications

We reserve the right to modify, update, or discontinue any aspect of Property Aura at any time. We will provide reasonable notice of material changes that affect your use of the platform.

User Accounts and Responsibilities

Account Creation

To use Property Aura, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Eligibility Requirements

You must be at least 18 years old and legally capable of entering into binding agreements to use Property Aura. By creating an account, you represent and warrant that you meet these requirements.

Account Security

You are responsible for maintaining the security of your account and must immediately notify us of any unauthorized access or security breaches. We recommend using strong passwords and enabling two-factor authentication when available.

Accurate Information

You agree to provide accurate, truthful, and complete information about your properties, tenants, and financial data. Providing false or misleading information may result in account suspension or termination.

Compliance with Laws

You agree to use Property Aura in compliance with all applicable local, national, and international laws and regulations, including but not limited to landlord-tenant laws, fair housing regulations, and data protection requirements.

Acceptable Use Policy

Permitted Uses

Property Aura may only be used for legitimate property management activities, including managing rental properties, communicating with tenants, tracking finances, and conducting related business activities as a property owner or authorized agent.

Prohibited Activities

You may not use Property Aura to: (a) violate any laws or regulations; (b) infringe on intellectual property rights; (c) transmit harmful, threatening, or illegal content; (d) attempt to gain unauthorized access to our systems; (e) interfere with other users' access to the platform; or (f) use the service for any fraudulent or deceptive purposes.

Content Standards

All content you upload or share through Property Aura must be appropriate, legal, and relevant to property management activities. We reserve the right to remove content that violates these standards or our community guidelines.

Tenant Privacy

When managing tenant information through Property Aura, you must comply with applicable privacy laws and obtain necessary consents. You are responsible for ensuring your tenant data collection and processing practices are lawful.

Platform Security

You may not attempt to reverse engineer, decompile, hack, or otherwise compromise the security or functionality of Property Aura. Any security vulnerabilities discovered should be reported to our security team immediately.

Subscription Plans and Billing

Free Tier

Property Aura offers a free tier that includes basic property management features for up to 1 property. The free tier is provided 'as-is' with no guarantee of service availability or support response times.

Paid Subscriptions

Paid subscription plans offer additional features, increased property limits, priority support, and advanced functionality. Subscription fees are billed monthly or annually as selected during signup.

Billing and Payment

Subscription fees are charged automatically to your chosen payment method. You are responsible for maintaining valid payment information and ensuring sufficient funds are available for automatic billing.

Refund Policy

We offer a 30-day money-back guarantee for new paid subscriptions. Refund requests must be submitted within 30 days of your initial subscription purchase. Refunds are not available for subscription renewals or usage-based charges.

Subscription Changes

You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Changes take effect at the next billing cycle unless otherwise specified.

Late Payments and Suspension

If payment fails, we will attempt to collect payment for up to 7 days. If payment cannot be collected, your account may be suspended until payment is received. Suspended accounts retain data but have limited access to features.

Data Ownership and Usage Rights

Your Data Ownership

You retain full ownership of all property data, tenant information, financial records, and other content you upload to Property Aura. We do not claim ownership of your data and will not use it for purposes other than providing our services.

License to Use

By using Property Aura, you grant us a limited, non-exclusive license to access, store, process, and transmit your data solely for the purpose of providing our property management services to you.

Data Portability

You may export your data from Property Aura at any time using our data export tools. We support standard formats to ensure you can migrate your data to other platforms if desired.

Data Retention

We will retain your data for as long as your account is active or as needed to provide services. After account termination, we will delete your data within 90 days unless retention is required for legal or regulatory purposes.

AI Training Data

Your personal property and tenant data will not be used to train artificial intelligence models. Only anonymized, aggregated usage patterns may be used to improve our AI assistant features, with all personally identifiable information removed.

Service Availability and Support

Service Uptime

We strive to maintain 99.9% uptime for Property Aura, but cannot guarantee uninterrupted service. Planned maintenance will be scheduled during low-usage periods with advance notice when possible.

Support Levels

Free tier users receive basic email support with responses within 72 hours. Paid subscribers receive priority support with faster response times and additional support channels including live chat.

Service Limitations

Property Aura is provided 'as-is' and we make no warranties about the accuracy, reliability, or completeness of the service. You are responsible for maintaining your own backups of critical data.

Third-Party Integrations

Property Aura may integrate with third-party services (payment processors, banks, etc.). We are not responsible for the availability, functionality, or security of these third-party services.

Force Majeure

We are not liable for service interruptions caused by events beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.

Liability and Disclaimers

Disclaimer of Warranties

Property Aura is provided 'as-is' without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Property Aura's total liability to you for all claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Consequential Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, regardless of the theory of liability.

Legal and Regulatory Compliance

Property Aura provides tools to assist with property management but does not provide legal advice. You are responsible for ensuring your property management practices comply with all applicable laws and regulations.

AI Assistant Limitations

Our AI Landlord Assistant provides general guidance and suggestions but should not be considered professional legal, financial, or tax advice. Always consult with qualified professionals for specific legal or financial matters.

User Responsibility

You acknowledge that property management involves inherent risks and responsibilities. Property Aura is a tool to assist you, but ultimate responsibility for your property management decisions remains with you.

Account Termination

Termination by You

You may terminate your Property Aura account at any time by following the account closure process in your settings. Upon termination, your access to the platform will cease immediately.

Termination by Us

We may suspend or terminate your account if you violate these Terms of Service, engage in prohibited activities, fail to pay subscription fees, or for any other reason at our sole discretion with reasonable notice.

Effect of Termination

Upon termination, your right to access Property Aura will cease immediately. You will remain liable for all charges incurred prior to termination. We will provide a reasonable opportunity to export your data.

Data Deletion

After account termination, we will delete your personal data within 90 days unless retention is required for legal, regulatory, or legitimate business purposes. Some information may remain in backups for a limited time.

Survival of Terms

Provisions relating to intellectual property, confidentiality, liability limitations, and dispute resolution will survive termination of your account and these Terms of Service.

Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].

Dispute Resolution Process

Arbitration Agreement

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes, we will:

  • Send email notification to active account holders for material changes
  • Display a prominent notice on the Property Aura platform
  • Provide 30 days advance notice for changes that materially affect your rights

Your continued use of Property Aura after any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our services and may terminate your account.

Severability and Entire Agreement

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by Property Aura, constitute the entire agreement between you and Property Aura concerning your use of our services.

Assignment

You may not assign or transfer these Terms or your Property Aura account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets with reasonable notice to you.

These Terms of Service are effective as of September 21, 2025. By using Property Aura, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
